Further to my comment about the legalities of this, I noted in my local Waitrose on Saturday that they now have notices up explaining that Apps are separate, and are not covered by the guarantee, and if they are discontinued, that this is not something that Waitrose would consider a fault, or a reason for return, refund or replacement.
i regard this attempted get-out as entirely void, at least for any service mentioned on the box, or in the sales literature that might have encouraged a purchase.
